    In the case of Attorney Pellegrini a quick search finds this case;

    Where Attorney Pellegrini prosecuted a man for failing to put down an elder horse.

    Even after the horse died of natural causes Attorney Pellegrini continued the state's prosecution.

    I have to wonder about the judgement of Attorney Pellegrini, what will he do if such cases appear before him.

    Violations of 209a restraining orders in particular. Often times people are prosecuted for talking to their children, when their children wish to talk to them. Improperly issued RO's allow the state to abuse a family in these situations.

    I would be concerned that a lawyer that can go over the top and prosecute someone for allowing their horse to die of natural causes, might also have issue with families doing typical things like talking to each other.

    Interesting comment, however most people that seek a nomination to the bench are not receiving the salaries that you list. They receive far less.

    For most judges a place on the bench is a big pay increase.

    Your argument does make sense if is to attract higher paid attorneys however that does not appear to be the point of the recommendations being put forth, if it was they might wish to only increase the pay of new judges.

    Furthermore your point does not appear to have any bearing on the way judges are chosen. Political considerations appear to play a much larger role than seeking the "most talented, experienced and efficient judges".

    On occasion an attorney will apply for a judgeship that is willing to take a pay cut, but that is the exception not the rule.

    The point I was trying to make was that the budget cuts, cut the support staff making it more difficult to perform the functions of the court. Restoring the support staff would give more jobs to more people and increase the effectiveness of the courts.

    Giving a pay increase to judges at this time would only increase the benefits to the judges without addresses the problems the courts face.

    I don't fully understand your claim regarding the cost to replace a judge. Perhaps you would wish to clarify.

    The Boston Globe's problem with the Governor's Council is that they are now actually doing their job.

    Rather than simply rubber stamping nominations they are actually creating a public record about each of these nominees.

    The Boston Globe alleges that the Council "has deterred qualified candidates from seeking to become a judge" yet do they provide one example of a qualified candidate taking a pass?

    In the past two months more and more sole practitioners are getting a chance at a judgeship, unheard of just a few months ago.

    Isn't it just like big media to pine for the good old days when it was not as important what you know as it is who you know.

    One of the reasons I have been blogging about the Governor's Council is to inform people of its function and the issues it faces.

    Obviously you are getting your information from another source, I'm not sure what your source is or how reliable it is.

    On the one had you acknowledge that most people know little about it on the other hand you claim it is giving Massachusetts a "bad" name, which is a contradiction.

    There are plenty of elected offices that most citizens have no idea who holds them, should we simply dissolve our "democracy" and if so what would you want in its place.

    The Governor's Council performs an important function, holding public hearings on judicial appointments, would you prefer that a governor be able make these lifetime appointments without any oversight?

    If you that is your view, fine, but you would be the first person that I know of that holds that view, which is kind of extreme.

    I realize the media ran a bunch of stories urging that the Governor's Council be done away with, most of them were ill informed and poorly written, you should take care where you get your information from.

    I do not have recordings of the Lenk hearing.

    There are plenty of them around as there were many reporters there.

    This is one of the reasons I am trying to post the hearings.

    The Lenk hearing was fascinating for a variety of reasons, however the reporting in the media was something else.

    I believe the courts are claiming a jurisdictional issue.

    Immigration status is a federal issue.

    I believe probation deals with immigration, so if you have a jail sentence you might have some INS trouble as well.

    I have seen people get more of a break because they have an illegal status, which isn't right.

    As to driving without a license I believe that usually gets a fine, a slap on the wrist
